Section 40. Parliamentary privilege

40. Personal data are exempt from—

(a) the first data protection standard, except to the extent to which that standard requires compliance with the conditions set out in sections 23(1) and 24(1);

(b) the second, third, fourth and fifth data protection standards;

(d) sections 11 and 13(3) and (4), if the exemption is required for the purpose of avoiding an infringement of the privileges of either House of Parliament. Domestic
