Section 38. Information available to the public by or under any enactment

38. Personal data consisting of information which the data controller Information is obliged by or under any enactment, other than the Access to the public by Information Act, to make available to the public (whether by publishing or under ay

the information, making it available for inspection, or otherwise, and whether gratuitously or on payment of a fee) are exempt from—

(a) the disclosure to data subject requirements;

(b) the fourth data protection standard and section 13(3) and

(4); and
